Commonwealth Virtual University Act 2011
(Act No. ............. to 2011)

An Act to establish a Virtual University in the --------------and to provide for matters connected therewith or incidental thereto.

Chapter - I
Preliminary

Short title and 1. (i) This Act may be called Commonwealth Virtual University Act 2011.

(ii) It shall be deemed to have come into force on the date, the Notification is issued by the Federal / State / Provincial Government.

Definitions 2. (i) In this Act, unless the context otherwise requires, -

(a) Academic Council means the Academic Council of the University;

(b) Board of Governors means Board of Governors of the University;

(c) Board of Management means Board of Management of the University;

(d) Constituent College means a college or institution maintained by the University;

(e) Chancellor means Chancellor of the University;

(f) Distance/Open/Virtual Education System means the system of imparting education through any means of communication such as broadcasting, telecasting, correspondence course, seminar, contact programme, online and web based virtual education mode or a combination of any two or more such means;

(g) Employee means employee appointed by the University; and includes teachers and other staff of the University or a constituent college;

(h) Faculty means faculty of the University;

(i) Finance Officer means Finance Officer of the University;

(j) Other Backward Classes of Citizens means the backward classes of citizens;

(k) "Prescribed" means prescribed by the statutes;

(l) Pro Chancellor means Pro Chancellor of the University;

(m) Pro Vice Chancellor means Pro Vice Chancellor of the University;

(n) Principal in relation to a constituent college, means the Head of the constituent college and includes, where there is no Principal, the Vice Principal or any other person for the time being appointed to act as Principal.

(o) Registrar means Registrar of the University

(p) Statutes and Rules means, respectively, the Statutes and Rules of the University;

(q) State means the Country / State where the University is being established.

(r) Teacher means a Professor, Associate Professor, Assistant Professor/Lecturer or such other person as may be appointed for imparting instruction or conducting research in the University or in a constituent college and includes the Principal of a constituent college;

(s) University means Commonwealth Virtual University established under this Act;

(t) Vice Chancellor means Vice Chancellor of the University.

(u) Visitor means Visitor of the University.

(v) Commonwealth of Virtual Education and Research (COVER) means the Charity registered at New Delhi as a Public Charitable Trust;

Chapter - II
The University and its objects

Establishment 3. (i) The Commonwealth of Virtual Education and Research (COVER)
of the University shall have the right to establish the University in accordance with the provisions of this Act.

(ii) The Commonwealth of Virtual Education and Research (COVER) shall, for the purposes of establishing the University under this Act, fulfil the following conditions within one year of the issue of legislation and notifications :

(a) creates an endowment fund in the name of the Commonwealth Virtual University for Rs. Two Crore.

(b) arranges temporary infrastructure and other facilities necessary for making the University functional;

(iii) The Headquarters of University shall be in the ---------------- and it may also have campuses at such other places as it may deem fit.

(iv) The Visitor, the Chancellor, the Pro Chancellor, the Vice Chancellor, the Pro Vice Chancellor, the Members of the Board of Governors, Members of the Board of Management and the Academic Council for the time being holding office as such in the University shall constitute a body corporate by the name of the University.

(v) On the establishment of the University, the land and other movable and immovable properties acquired, created, arranged or built by Commonwealth Virtual University for the purpose of the University except the properties of the Commonwealth of Virtual Education and Research (COVER) shall stand transferred to and vest in the University.

(vi) The use of land, building and other properties acquired for the University shall not be used for any purpose, other than that for which the same is acquired.

University not 4. The University has neither made a demand nor shall be entitled to
to be entitled any grants-in-aid or any other financial assistance from the State
to financial Government or any other body or corporation owned or controlled by the
assistance etc. State Government. However the State Government will be free to decide any assistance for the speedy development of the campus of the University.

No Power to 5. The University may have constituent colleges, branch campuses
affiliate any and / or study centres but shall have no power to admit any other
institution college or institution to the privileges of affiliation.

Objects of the 6. Objects of the University - The objectives for which the University is
University established are as follows :

(a) to design and conduct vocational and job oriented courses at secondary, post-secondary, bachelor's, master's and doctoral levels under virtual, online, distance and e-learning modes and to award degree, diploma and certificate to that effect;

(b) to conduct research in vocational, scientific, technological and related areas and to use and implement the results of such researches;

(c) to transfer the appropriate technologies of institution building developed by the University to different Universities and Institutions in India in particular and to all countries of the world in general.

Powers 7. The University shall have the following powers, viz, :

University (a) to provide for instruction in all vocational and job oriented subjects and allied fields and to make provision for research and for the advancement and dissemination of knowledge;

(b) to institute and confer degrees or other academic distinctions right from the school level to Bachelor's, Master's and Doctoral levels;

(c) to hold examinations for, and to grant and confer degrees or other academic distinctions to, and on, persons, who :

(i) have pursued a course of study in the University or in a constituent college or under a distance/open/virtual education system; or

(ii) have carried on research in the University or in a constituent college or under a distance/open/virtual education system;

(d) to confer honorary degrees or other academic distinctions in the manner and under conditions laid down in the statutes;

(e) to institute and award fellowships, scholarships and prizes etc. in accordance with the statutes;

(f) to demand and receive such fees and charges as may be fixed by the statutes or rules, as the case may be;

(g) to make provisions for the advancement of education in the areas mentioned above as well as in the new and other emerging areas.

(h) to make provisions for extra curricular activities for students and employees;

(i) to make appointments of officers and employees of the University or a constituent college;

(j) to receive donations and gifts of any kind and to acquire, hold, manage and dispose of any movable or immovable property, including trust and endowment properties for the purpose of the University or a constituent college after the prior permission of the Commonwealth of Virtual Education and Research (COVER);

(k) to institute and maintain halls and to recognize places of residence for students of the University or a constituent college;

(l) to supervise and control the residence, and to regulate the discipline of the students of the University or a constituent college and to make arrangements for promoting their health;

(m) to create academic, administrative, ministerial, clerical, supervisory and other posts for appointments in the University and constituent colleges;

(n) to cooperate and collaborate with other Universities, Colleges, and Institutions in such manner(s) and for such purposes as the University may determine from time to time;

(o) to provide internet based distance and virtual education programmes in different areas of studies and subjects;

(p) to organise and conduct refresher courses, orientation courses, workshops, seminars and other programmes for teachers, evaluators and other academic staff;

(q) to determine standards of admission of the University or a constituent college through specialised committees with the approval of the Academic Council;

(r) to make special provisions for students belonging to the Schedules Castes, the Scheduled Tribes and other categories for admission in any course in the University or in a constituent college;

(s) to lay down conditions of service of all categories of officers / employees of the University or a constituent college;

(t) to do all such other acts of things whether incidental to the powers aforesaid or not, as may be necessary to further the objects of the University.

University open 8. The University shall be open to all persons irrespective of class,
to all classes, creed or gender :

Chapter - III
Officers of the University

Officers 9. The following shall be the Officers of the University :

(b) Chancellor;

(c) Pro Chancellor;

(d) Vice Chancellor;

(e) Pro Vice Chancellor;

(f) Deans of Faculties;

(g) Registrar;

(h) Finance Officer; and

(i) such other officers as may be declared by the Statutes to be Officers of the University.

Visitor 10. (i) The President / Prime Minister will be the Visitor of Commonwealth Virtual University. He will be presiding over the Convocation of the University.

(ii) The Visitor will be the Chief Disciplinarian of the University and he will be advising the University for its optimal development.

Chancellor 11. (i) The person nominated by the promoter Trust i.e. Commonwealth of Virtual Education and Research (COVER), will be the first Chancellor of Commonwealth Virtual University, whose tenure shall be of five years. Thereafter the Commonwealth of Virtual Education and Research (COVER) would appoint the Chancellor from amongst its Trustees for the next five years and so on.

(ii) The Chancellor shall have such powers as may be conferred on him by this Act or the statutes made thereunder.

(iii) Every proposal for the conferment of an honorary degree of distinction shall be subject to the confirmation of the Chancellor.

(iv) The Chancellor shall, if present, assist the Visitor in conducting or in presiding at the convocation of the University held for conferring degrees and may delegate to any officer of the University such of his powers as he may consider necessary.

Pro Chancellor 12. (i) The Commonwealth of Virtual Education and Research (COVER) will appoint the Pro Chancellor of the University for assisting the Chancellor in discharging his duties.

(ii) The Pro Chancellor shall have such powers as may be conferred on him by the Chancellor in consultation with the Commonwealth of Virtual Education and Research (COVER).

Vice Chancellor 13. (i) The Vice Chancellor shall be appointed on such terms and
conditions as may be prescribed for a term of three years by the Chancellor from a panel of three persons recommended by the Committee constituted in accordance with the provisions of sub-section (II).

(ii) The Committee referred to in sub-section (I) shall consist of the following persons, viz, :

(a) One person nominated by the Chancellor.

(b) The Secretary to the State Government in the Department of Higher Education.

(c) Two nominees of the Commonwealth of Virtual Education and Research (COVER).

(iii) The Committee shall, on the basis of merit, prepare a panel of the names of three persons suitable to hold the office of the Vice Chancellor and forward the same to the Chancellor along with a concise statement showing the academic qualifications and other distinctions of each person.

(iv) The Vice Chancellor shall be the Principal Executive and Academic Officer of the University and shall exercise general supervision and control over the affairs of the University and give effect to the decisions of the authorities of the University.

(v) Where any matter other than the appointment of a teacher is of urgent nature requiring immediate action and the same could not be immediately dealt with by any officer or the authority or other body of the University empowered by or under this Act to deal with it, the Vice Chancellor may take such action as he may deem fit with the prior approval of the Chancellor.

(vi) The Vice Chancellor shall exercise such other powers and perform such other duties as may be laid down by the Statutes or the rules.

(vii) The Chancellor is empowered to remove the Vice Chancellor after due enquiry. It will be open to the Chancellor to suspend the Vice Chancellor during enquiry depending upon the seriousness of the charges as he deems fit.

Pro-Vice 14. The Pro-Vice-Chancellor shall be appointed by the Chancellor in such
Chancellor manner and shall exercise such powers and perform such duties as may be prescribed in statutes.

Deans of 15. The Deans of Faculties shall be appointed by the Vice Chancellor in
Faculties consultation with the Chancellor in such manner and shall exercise such powers and perform such duties as may be prescribed in statutes.

Registrar 16. (i) The Registrar shall be appointed by the Chancellor in such manner and on such terms and conditions as may be prescribed.

(ii) All contracts shall be entered into the signed by the Registrar on behalf of the University.

(iii) The Registrar shall have the power to authenticate records on behalf of the University and shall exercise such other powers and perform such other duties as may be prescribed or may be required from time to time, by the Chancellor / the Pro Chancellor / the Vice Chancellor / the Pro Vice Chancellor.

(iv) The Registrar shall be responsible for the due custody of the records and the common seal of the University and shall be bound to place before the Chancellor / the Pro Chancellor / the Vice Chancellor / the Pro Vice Chancellor or any other authority, all such information and documents as may be necessary for transaction of their business.

Finance Officer 17. The Finance Officer shall be appointed by the Chancellor in such manner
and shall exercise such powers and perform such duties as may be prescribed or may be required by the Chancellor / the Pro Chancellor /
the Vice Chancellor / the Pro Vice Chancellor or the Registrar.

Other Officers 18. The manner of appointment, terms and conditions of service and powers and duties of the other officers of the University shall be such as may be prescribed.


Chapter - IV
Authorities of the University

Authorities of 19. The following shall be authorities of the University, namely :
the University
(i) Board of Governors;

(ii) Board of Management;

(iii) Academic Council;

(iv) Finance Committee; and

(v) Such other authorities as may be declared by the Statutes to be the authorities of the University.

Board of 20. (i) The Board of Governors shall consist of :

(e) Five persons nominated by

(h) Two academicians nominated by
the Chancellor. Member

(i) Registrar Member Secretary

(j) Finance Officer Member

(k) Such other Members coopted by the Chancellor / Commonwealth of Virtual Education and Research (COVER) as special invities.

(ii) The Board of Governors shall be the principal governing body of the University and shall have the following powers, namely:

(a) to review decisions of the other authorities of the University if they are not in conformity with the provisions of this Act, or the Statutes of the Rules;

(b) to approve the budget and annual report of the University;

(c) to lay down policies to be pursued by the University;

(d) to make new or additional Statutes or amend or repeal the earlier Statutes and Rules;

(e) to take decision about voluntary winding up of the University;

(f) to approve proposals for submission to the State Government; and

(g) to nominate an observer or observers who will from time to time, under the advice and directions of the Chancellor, decide the policy and framework within which the Board of Management, Academic Council, Finance Committee and such other authorities as may be declared in the statutes, will function and pass resolutions for the proper administration of the University.

(iii) The Board of Governors shall, meet three times in a year at such time and place as the Chancellor thinks fit.

Board of 21. (i) The Board of Management shall consist of :

by rotation for a period of one year; Member

(h) Two persons nominated by the
Chancellor; Member(s)

(i) Registrar Member Secretary

(j) Finance Officer Member

(k) Such other Members coopted by the Chancellor / Commonwealth of Virtual Education and Research (COVER) as special invities.

(ii) The powers and functions of the Board of Management shall be such as may be prescribed.

Academic 22. (i) The Academic Council shall consist of :

(ii) The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act, the Rules, the Statutes and the Acts, coordinate and exercise general supervision over the academic policies of the University.

Finance 23. (i) The Finance Committee shall consist of :

(ii) The Finance Committee shall be the principal financial body of the University to take care of financial matters and shall, subject to the provisions of this Act, Rules, Statutes and Acts, co-ordinate and exercise general supervision over the financial matters of the University.

Other 24. The constitution, powers and functions of the other authorities

Proceedings 25. No Act or Proceedings of any Authority of the University shall be

Chapter - V
Statutes and Rules

Statutes 26. Subject to the provisions of this Act, and the Rules, the Statutes may provide for any matter relating to the University and staff, in particular, provide for :

(i) the procedure for transaction of business of the Authorities of the University and the composition of bodies not specified in this Act;

(ii) the operation of the permanent endowment fund, the general fund and the development fund;

(iii) the terms and conditions of appointment of the Pro Chancellor, the Vice Chancellor, the Pro Vice Chancellor, the Registrar and the Finance Officer and their powers and functions;

(iv) the mode of recruitment and the conditions of service of the other officers, teachers and employees of the University;

(v) the procedure for resolving of disputes between the University and its officers, faculty members, employees and students;

(vi) creation, abolition or restructuring of departments and faculties;

(vii) the manner of co-operation with other Universities or institutions of higher learning;

(viii) the procedure for conferment of honorary degrees;

(ix) provisions regarding grant of freeships and scholarships;

(x) number of seats in different courses of studies and the procedure of admission of students to such courses including reservation of seats;

(xi) the fee chargeable from students for various courses of studies;

(xii) institution of fellowships, scholarships, studentships, freeships, medals and prizes;

(xiii) procedure for creation and abolition of posts;

(xiv) other matters which are to be or may be prescribed.

Statutes how 27. (i) The Statutes shall be made by the Commonwealth of Virtual Education and Research (COVER) and the Statutes so made shall be presented before the Board of Governors and the Board of Management for its final approval with or without modification.

(ii) The Statutes so made will be notified by the University.

(ii) A copy of each of the Statutes will be sent to the State Government for information and records.

Power to 28. The Board of Governors may make new or additional Statutes or amend
amend the or repeal the Statutes should these be deemed necessary in the interest
Statutes of the University.

Acts 29. Subject to the provisions of this Act, the Rules and the Statutes may provide for all or any of the following matters, namely :

(i) admission to students to the University and their enrolment and continuance as such;

(ii) the courses of study to be laid down for all degrees and other academic distinctions of the University;

(iii) the award of degrees and other academic distinctions;

(iv) the conditions of the award of fellowships, scholarships, studentships, medals and prizes;

(v) the conduct of examinations and the conditions and mode of appointment and duties of examining bodies, examiners, invigilators, tabulators and moderators;

(vi) the fee to be charged for admission to the examinations, degree and other academic distinctions of the University;

(g) the conditions of residence of the students at the University.

(h) maintenance of discipline among the students of the University of a constituent college;

(i) all other matters may be provided in the statutes and rules under the Act.

Rules 30. (i) The Rules shall be made by the Commonwealth of Virtual Education and Research (COVER) and the rules so made shall be submitted to the Board of Governors and the Board of Management for its approval with or without modification.

(ii) The Rules so made will be notified by the University.

(ii) A copy of each of the Rules will be sent to the State Government for information and records.

Power to 31 The Academic Council may, with the approval of the Board of

Chapter - VI
Miscellaneous

Conditions 32. (i) Every employee shall be appointed under a written contract, which

(ii) The University is empowered to take disciplinary action against the student/employees as per procedure prescribed in the statutes.

(iii) Any dispute arising out of the contract between the University and an employee shall, at the request of the employee, be referred to a Tribunal of arbitration consisting of one member appointed by the Board of Management, one member nominated by the employee concerned and an umpire appointed by the Chancellor.

(iv) The decision of the Tribunal in such matter shall be final.

(v) The procedure for regulating the work of the Tribunal shall be such as may be prescribed.

Procedure of 33. The University shall take disciplinary action against any student as per

Right to 34. Every employee or student of the University or of a constituent
appeal college shall, notwithstanding anything contained in this Act, have a right to appeal within such time as may be prescribed, to the Board of Management against the decision of any Officer or Authority of the University or of the Principal of any such college, as the case may be, and thereupon the Board of Management may confirm, modify or change the decision appealed against.

Provident 35. The University shall constitute for the benefit of its employees such

Disputes as 36. If any question arises as to whether any person has been duly elected
to constitution or appointed as, or is entitled to be a member of any authority or

Constitution 37. Whether any authority of the University is given power by this Act
of Committees or the Statutes to appoint Committees, such Committees shall, save as otherwise provided, consist of any or all the members of the authority concerned and of such other persons, if any, as the authority in each case think fit.

Filling of 38. Any casual vacancy among the members, other than ex-officio
Casual members, of any Authority or body of the University shall be filled in
Vacancies the same manner in which the member whose vacancy is to be filled up, was chosen, and the person filling the vacancy shall be a member of such authority or body for the residue of the term for which the person whose
place he fills would have been a member.

Protection of 39. No suit or other legal proceedings shall lie against any officer or
action taken other employee of the University for anything which is done in good faith
in good faith or intended to be done in pursuance of the provisions of this Act, the statutes or the rules.

Transitional 40. Notwithstanding anything contained in any other provisions of this Act

(i) the first Pro Chancellor, Vice Chancellor and Pro Vice Chancellor shall be appointed by the Chancellor and the said Officer shall hold office for a term of three years;

(ii) the first Registrar and the first Finance Officer shall be appointed by the Chancellor who shall hold office for a term of three years;

(iii) the first Board of Governors shall be nominated by the Chancellor and they shall hold office for a term of three years;

(iv) the first Board of Management shall be constituted by the Chancellor for a term of three years;

(v) the first Finance Committee shall be constituted by the Chancellor for a term of three years;

(vi) the first Academic Council shall be constituted by the Chancellor for a term of three years.

Permanent 41. (i) The University shall establish a permanent endowment fund
Endowment for the overall development of the University based on the need of

(ii) The University shall have power to invest the permanent endowment fund in such manner as may be prescribed.

(iii) The University may transfer any amount from the general fund or the development fund to the permanent endowment fund. Excepting the dissolution of the University, in no other circumstances can any monies be transferred from corpus of the endowment fund to other purposes.

General 42. (i) The University shall establish a General Fund to which the following
Fund amount shall be credited, namely :

(a) all fees which may be charged by the University;

(b) all sums received from any other source;

(c) all contributions made by the Commonwealth of Virtual Education and Research (COVER); and

(d) all contributions / donations made in this behalf by any other person or body which are not prohibited by any law for the time being in force.

(ii) The funds credited to the General Fund shall be applied to meet all the recurring expenditure of the University.

Development 43. (i) The University shall also establish a development fund to which the

(a) development fees which may be charged from students;

(b) all sums received from any other source for the purposes of the development of the University;

(c) all contributions/donations made in this behalf by any other person or body which are not prohibited by any law for the time being in force; and

(d) all incomes received from the permanent endowment fund.

(ii) The funds credited to the development fund from time to time shall be utilized for the development of the University.

Annual 44. (i) The Annual Report of the University shall be prepared under
Report the direction of the Board of Management and shall be submitted to the Board of Governors for its approval.

(ii) The Board of Governors shall consider the Annual Report in its meeting and may approve the same with or without modification.

(iii) Copy of the Annual Report duly approved by the Board of Governors shall be sent to the State Government for information and records

Accounts 45. (i) The Annual Accounts and Balance Sheet of the University shall be
and Audit prepared under the direction of the Board of Management and all
funds accruing to or received by the University from whatever source and all amount disbursed or paid shall be entered in the accounts maintained by the University.

(ii) The Annual Accounts and the Balance Sheet of the University shall be audited every year by the auditors appointed by the University, who are members of the Institute of Chartered Accounts of India.

(iii) A copy of the Annual Accounts and the Balance Sheet together with the Audited Report shall be submitted to the Board of Governors.

(iv) The Annual Accounts, the Balance Sheet and the Audit Report shall be considered by the Board of Governors at its meeting and the Board of Governors shall forward the same of the State Government along with its observations thereon.

Mode of proof 46. A copy of any receipt, application, notice, order, proceeding or
of University resolution of any authority or committee of the university or other
Record documents in possession of the University or any entry in any register duly maintained by the University, if certified by the Registrar, shall be received as prima facie evidence of such receipt, application, notice, order, proceeding, resolution or document or the existence of entry in the register and shall be admitted as evidence of the matters and transaction therein recorded where the original thereof would, if produced, have been admissible in evidence.

Dissolution of 47. If the Commonwealth of Virtual Education and Research (COVER)
the University proposes to desolve the University, the following action will be required to be initiated :

(i) The Commonwealth of Virtual Education and Research (COVER) will have to inform the State Government giving reasons regarding its inability to run the University.

(ii) The Commonwealth of Virtual Education and Research (COVER) will be required to further run the University till the existing students complete their courses.

Expenditure of 48. (i) The Expenditure for the administration of the University during the
the University period of the decision to wind up and till the existing students
during its complete their courses will be met by the Commonwealth of Virtual
disolution Education and Research (COVER).

(ii) If the funds referred to in sub-section (i) are not sufficient to meet the expenditure of the University during the winding up period, such expenditure may be met out by disposing of the properties or the assets of the University, by the Commonwealth of Virtual Education and Research (COVER).
